Terms of Service

1. Acceptance of terms

By accessing or using ChillPoint Climate Crew (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What we do

ChillPoint is a lead-referral service. We match homeowners who submit quote requests with independent, licensed HVAC contractors (“partner contractors”). ChillPoint is not an HVAC contractor, does not perform HVAC work, and is not a party to any contract you enter into with a partner contractor.

3. Eligibility

You must be at least 18 years old and the owner (or authorized representative of the owner) of the property where service is requested.

4. Quote requests, SMS & call consent

By submitting a quote request, you:

• Authorize ChillPoint to share the contact details you provide (including name, phone, email, ZIP, and job description) with up to three (3) partner contractors.
• Consent to receive calls, SMS/MMS text messages, and emails from ChillPoint and those partner contractors at the phone number and email you provided, including via automated dialing systems and prerecorded messages, for the purpose of delivering quotes and scheduling service. Message and data rates may apply. Consent is not a condition of any purchase.
• Understand you may opt out of SMS at any time by replying STOP, and opt out of email via the unsubscribe link in any message.

5. Partner contractors are independent

Partner contractors are independent businesses, not employees or agents of ChillPoint. We screen contractors for licensing and insurance where required, but we do not supervise their work. Any agreement, quote, payment, warranty, or dispute regarding services is strictly between you and the contractor.

6. No warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of liability

To the fullest extent permitted by law, ChillPoint will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service or any services provided by a partner contractor.

8. Prohibited use

You agree not to submit false, misleading, or fraudulent information; request quotes on behalf of someone who has not consented; or use the Service for anything other than obtaining HVAC service for a property you are authorized to represent.

9. Changes

We may modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the state in which ChillPoint is organized, without regard to conflict-of-laws principles.
